CITY OF SPOKANE VALLEY, WASHINGTON

 NOTICE OF PUBLIC HEARING

 NOTICE IS HEREBY GIVEN that the City Council of the City of Spokane Valley, Washington (“City”) will hold a public hearing in the Great Room of CenterPlace Regional Event Center, located at 2426 North Discovery Place, Spokane Valley, Washington, on November 14, 2023 at 6:00 p.m., for the purpose of taking public testimony on the City’s proposed assumption of the rights, powers, functions, and obligations of the Spokane Valley Transportation Benefit District. All interested persons are invited to attend and provide comments on the proposed assumption of the Spokane Valley Transportation Benefit District.

 Written comments may be submitted to the City until 4:00p.m. on November 14, 2023 per the Council agenda. 

 Pursuant to RCW 36.74.020, the City Council’s Resolution of Intent states:

RESOLUTION NO. 23-012

 A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY, WASHINGTON, DECLARING THE COUNCIL’S INTENTION TO CONSIDER ASSUMING THE RIGHTS, POWERS, FUNCTIONS, AND OBLIGATIONS OF THE SPOKANE VALLEY TRANSPORTATION BENEFIT DISTRICT, SETTING A PUBLIC HEARING REGARDING SUCH ASSUMPTION, AND OTHER MATTERS RELATED THERETO. 

          WHEREAS, the City of Spokane Valley, Spokane County, Washington (the “City”) has the responsibility under the Constitution and laws of the State of Washington to maintain streets for the benefit of the public for the purposes of commerce, public safety, and transportation throughout the City; and

           WHEREAS, pursuant to Ordinance No. 23-018 passed by the City Council on October 24, 2023, the City created the Spokane Valley Transportation Benefit District and adopted a new chapter 3.85 to the Spokane Valley Municipal Code governing the same; and

           WHEREAS, chapter 36.74 RCW authorizes a city to assume the rights, powers, functions, and obligations of a transportation benefit district established by a city; and

           WHEREAS, in order to assume the rights, powers, functions, and obligations of a transportation benefit district, the city legislative body must adopt an ordinance or resolution declaring its intention to consider assumption and setting a public hearing for such consideration; and

           WHEREAS, notice of such proposed hearing must be published at least two times during the two weeks preceding the scheduled hearing in a newspaper of general circulation in the city where the transportation benefit district is located; and

           WHEREAS, as authorized by RCW 36.74.020, the City Council desires to consider assumption and to schedule the required public hearing. 

           NOW, THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane County, Washington, as follows:

           Section 1.   Establishment of Public Hearing Date and Time.  A public hearing shall be held in the Great Room of CenterPlace Regional Event Center, located at 2426 North Discovery Place, Spokane Valley, WA, on the 14th day of November, 2023 at 6 p.m. or as soon thereafter as it may be heard, at which time the Spokane Valley City Council shall hear testimony from any person on the proposed assumption of the rights, powers, functions, and obligations of the Spokane Valley Transportation Benefit District.  Notice of said public hearing shall be published in the Spokane Valley News Herald and the Spokesman Review on November 3 and November 10, 2023. 

           Section 2.          Effective Date.   This Resolution shall be effective immediately upon passage and signatures hereto. A fully signed copy of this Resolution can be provided upon request.

 PASSED by the City Council this 31st day of October, 2023.
